All Uchiha are ruled out because the Uchiha clan's chakra nature affinity is Fire Release. Tobi does not even use Fire Release, much less let it be his affinity. If you say the Rinnegan lets him use Fire Release, I will tell you that I am talking about his chakra nature BEFORE the Rinnegan. Tobi uses only Earth Release, which is his affinity. Tobi is also not someone who has been previously granted Jounin rank in Konohagakure. During Naruto's chakra nature training, Kakashi said that to become a Jounin rank shiniobi or kunoichi in Konohagakure, one must first have mastered at least two chakra nature types. Even after obtaining the Rinnegan, we have not seen Tobi use anything but Earth Release Techniques, and Earth release is still his affinity. Plus, Tobi is the only member of Akatsuki other than Zetsu (Kabuto is not an official member) who does not have a forehead protector on. This can only mean one thing. Masashi Kishimoto will be sitting in a room somewhere laughing when we read the next manga and see his obvious answer to Tobi's identity.

Tobi = Obito, who didn't exactly die, but rather, was in a limbo where he meets a wrinkly Madara Uchiha. Madara convinces Tobi to join him in world domination, which is sort of like the Eye of the Moon Plan Tobi has. Obito initially declines and goes back to the land of the living to find Kakashi and Rin. When he finds them, he sees that Kakashi had supposedly Chidori'd Rin because she was apparently a double-agent. And so, Obito Uchiha completely flips and joins Madara Uchiha because he was friend-zoned by Rin and also because Kakashi kills his crush.
Tobi isn't Uchiha Madara. The REAL Uchiha Madara was resurrected by Yakushi Kabuto to win the Fourth Great Ninja War. Tobi himself said: "I'm nobody, and I don't want to be anybody." We all know Obito is dead; he was crushed under a boulder for Pete's sake! Rin and Kakashi themselves watched him die, plus Obito said after giving Kakashi the Sharingan; "I will see what the future holds through your eyes." Then more boulders crushed him. If there had been any possible chance he'd survive, Namikaze Minato would have saved him somehow. So no, Tobi is not Uchiha Madara, he is Nobody.

It is Madara Uchiha, the person that would be the first hokage, but he loses his battle and the honor of the Uchiha. (Orochimaru has got his body, so he takes the body of Obito, the uncle of Sasuke, that gives his sharingan to Kakashi) Obito's face is deformed so he takes a mask.

Yes, he is. As of Naruto chapter 599, it is confirmed that "Tobi" is in fact Obito Uchiha. After a cave-in supposedly "killed" his body, he was rescued by an elderly Madara Uchiha using the Gedo Mazo statue to preserve his life. Once Madara died, Obito adopted his name and carried on his plan, under the assumption that because Rin was gone, life had no purpose.
