because he doesnt kill Harry Potter. he kills the horcrux that he accidently placed inside harry on the night when james and lily died. that is why harry comes back to life. he is not dead, the horcrux is

At the end of Harry Potter and the Deathly Hallows on the 2nd May 1998 during the final battle. Lord Voldemort cast the killing curse at Harry using the elder wand, which Harry was technically the master of. The wand cannot be used against it's owner and so, the wand flew out of Voldemort's hand and Harry cast expelliarmus resulting in the spell hitting a now defenceless Voldemort.
