because he doesnt kill Harry Potter. he kills the horcrux that he accidently placed inside harry on the night when james and lily died. that is why harry comes back to life. he is not dead, the horcrux is

Lord Voldemort cast the killing curse at Harry using the elder wand, which Harry was technically the master of. The wand cannot be used against it's owner and so, the wand flew out of Voldemort's hand and Harry cast expelliarmus resulting in the spell hitting a now defenceless Voldemort.

Well the Elder wand has a long backstory but basically Dumbledore starts off with it in the book. Then when Draco disarms Dumbledore he becomes it's master unknowingly. Then Harry over powers Draco becoming the new owner. Voldemort kills Snape who killed Dumbledore so he BELIEVES that he is the true master of the Elder Wand. Then Harry and Voldemort face off Harry being the master of the Elder Wand. Voldemort's wand (The Elder wand) Then flies to it's true owner leaving Voldemort defenceless. Hope it helps!

No they can't for two reasons. Part of Voldemort's soul was inside Harry and the only way to destroy Voldemort was to destroy all bits of his soul - therefore Harry had to be hit by the killing curse. On top of that Voldemort was using the Elder Wand which regonzised Harry as it's owner because Harry overpowered the previous owned of the wand (Draco Malfoy) who had become the owned by disarming Dumbledore before his death. Therefore when Voldemort sent the killing curse towards Harry and he disarmed it the elder wand flew from Voldemort's hand (allowing Harry's disarming curse to send the killing curse back to Voldemort which then hit and killed him) into Harry's hand.
