If they hit a "pedestrian" or "pedistrian" probably the one walking illegally.
their fault because they werent in the cross walk
You Dummy!!
At least partially.
Yes. Being illegally parked does not affect fault. If you strike a parked vehicle, it is ALWAYS your fault because you have a duty to ensure the way was clear before moving.
If the person backing out of the space had not seen a pedestrian walking the "wrong way" it would be the fault of the driver of the car backing out....... So it is the fault of the person backing out. They did not look to make sure it was safe to do so.
If he was truly stationary and you hit him, you are probably at fault. If he was illegally going through the turn, he might be at fault.
I'm from Michigan, so it is no one's fault HEHEHEHEHEHEHEHEH.
It would be the car who had parked illegally because he was not parked in a legal spot.
They didn't slip and fall because the car was were it was. They slipped and fell because of what they were walking on. If it was uneven, slippery, poorly maintained, they might be able to sue the owner of the property. If it was common for a vehicle to be parked where it was, it strengthens the case that people often had to walk there.
A vehicle that has an accident while doing an illegal maneuver is automaticly at fault. However the other may be at fault too depending on the circumstance. additional thought here The motorcycle may have a problem because they don't belong in the carpool lane.
