No, the seal is still intact. He was about to break it when fighting with Pein by transforming to 8 tails but Minato appeared in his sub-conciousness and made the seal again.
It is a Double tetragram seal with a 8 sign seal, so that if any of the 9 tails chakra is released it will form into Naruto's chakra. It then has a 5 Pronged seal in witch Orochimaru put there to fully suppress the 9 tails chakra to make Naruto weaker
