Could simply just be dirty. Put the gate down, and unscrew the back of the handle. Once you unscrew the tail gates handle. then unscrew the ends where the latchs are. Then you should be able to pull the latchs out and clean them.
Just clean the handle and latchs and it should be fine. I know mine needed it.

remove the panel from the gate (it may be difficult if the gate is still closed). there is a metal panel held w/ screws; remove that panel and the latch will be visible. pull both rods at the same time to unlatch the gate (careful, the space is small and the truck loves to pinch!).
