This just happened to ME less than 4 hours ago. I was cited the ticket for pulling into traffic even though the teen who hit me was going about 70 mph. The cops said that they didn't see it as a high impact crash, but he hit my Saab tail bad enough that it had to be towed. The dummy also said..."look there's no brake or skid marks?!" Yeah, no kidding.
Usually their is no fault associated with parking lots. I'm sure your insurance company looks at it as your fault.

It depends. If they hit you with their door, it's usually their fault. If you hit their door with your car, it's most likely your fault. That said, the burden of ensuring the way is clear is ALWAYS on the reversing vehicle.

The legality of the spots geneally have nothing to do with the liabilty for the collision, and the decision would likely be made as if they were both legal parking spots.
