If the other person or driver was At Fault as you say, Then all you have to do is file a claim on that persons liability insurance. Hopefully you exchanged information at the scene of the accident.
how can i drive with provisional driving licence 49 cc scooter
then your both screwed
The driver does not have proper insurance at this point. since the insurance did not cover provisional licenses, the insurance provider mask likely does not have to pay out on any claim.
Most cases you get jailed if the accident is severe. If its not too much you get a ticket for driving without licensed driver. Depends on country to country though
Hopefully you were not driving alone ... could lose your license for that. Otherwise, it works the same as if you had a normal license ... the police will take down all the information - whomever was in the front passenger seat (hopefully a licensed driver over the age of 21) will also have to accept responsibility, as you were driving under their guidance and direction.

You must be licensed to drive, or have a permit and a licensed driver with you. Otherwise, there are legal consequences for that driver. The insurance company may not pay for any damages depending on the policy.
If stopped or in an accident they will be arrested and the vehicle will be impounded. This is the only answer I can give you.
You will be arrested or ticketed for being an un-licensed operator. The owner of the vehicle will become personallyfinancially liable for any damages or suits for injury because they allowed an un-licensed operator to operate their vehicle.
If they are stopped your car could be impounded. If they get into an accident you are responsible for damages of your car and the other person's car. Not worth letting them drive.
They can be sued by the other driver for damamges (if at fault). If not at fault, they may have a very difficult time getting insurance in the future and when they do, the premiums will be through the roof.
You'll probably get a ticket.
