The answer is different for medical expenses and physical damage to your car. Medical expenses can be paid by your insurance company if you have "uninsured/underinsured" coverage. This type of coverage is usually very inexpensive and I recommend everyone has it. Literally a few dollars per year. For property damage, you can sue the person, or your insurance can pay for it if you have full coverage (comprehensive/collision) insurance. Then it becomes their problem if they want to sue the person or not to get their money back.
