In America you CAN sue just about anyone, but you likely won't get anywhere with this one. You will need to ''sue''the At Fault party that caused you to lose wages, assuming you are talking about loss of wages from an injury you sustained. That a physican advised you to stay off of work for. If you care to explain the details, I will try and help you. There are times when you can sue your own insurance company for breach of contract, refusal to pay, bad faith, and so on, but if you want advise on if you have a claim, please either lay out the facts in the discussion forum on this question or on my message board, and I will try and help.

If your new car was parked and rear ended and considered a total loss and your insurance company is covering the cost of the car what are your rights in small claims court besides lost wages?

You must prove that you have a reasonable loss. Typically an insurance company would get you a rental car, or you could take a taxi, so lost wages would not be reasonable. (taxi fares & ins deductibles would be reasonable) Since you have no personal injury, your options are few.
