The moving car is At Fault. Say you parked on a hill and asked someone to look under the car then put it in neutral. The car rolled and they were injured. Do you really think because you were no longer in a car that they could not charge you. Of course this is minor and what caused the car to roll is not stated. If the car was in park or not on an incline it should not roll.
