Sometimes it isn't physical gifts that matter. It is the people in our lives, people that mean everything to us that are the real presents. Maybe its for just that reason that Santa does not deliver gifts to everyone. To make them/us realize what really matters in life is not gifts, but instead the people we love and cherish.

Good question. I am a parent and I give my kids presents. I can only speak for my self, I think. The best thing to do is check the label. If it says Santa, great. My wife and I always label our presents as from us. If you want to be sure who the presents are from, tell your parents that you want them to label presents they are giving with their names and not write "From Santa". Then, any presents that says "From Santa" ... hmm
Why does santa give presents?
As the previous answer says 'It became a tradition in the US', I simply believe that this is untrue. Santa Claus brings presents on Christmas Eve ( I am also writing this answer on Christmas Eve!) because he simply wants to bring happy Christmas spirit in the hearts of families. It is also caused by a tradition by Jesus Christ, whose birthday is on this day. Jesus' presents were gold, frankencence and myrrh.
