Today, in the U.S.A. There is no penalty for gay behavior in the military, unless it is sexual behavior, and public or in a prohibited place.
Prior to 2011, the "Don't Ask, Don't Tell" clause was implemented in the US Military, making it "supposedly" illegal for persons entering the military to even be asked their sexual preference.
Before DADT, unfortunately, the results of being gay and in the military was Dishonorable Discharge. Also unfortunately the DADT doesn't always guarantee that a homosexual in the military is safe, with the world still filled with narrow mindedness and bigotry many homosexuals are still persecuted if they are found out while listed. Although they can not legally be kicked out of the military for this reason, it's easy to find ways around it or other excuses as to discharge them from service.
The world is beginning in some ways to accept homosexuality, however, like any alternate lifestyle, religion, etc, there will always be some out there either cannot or just will not accept it.
A good example of this is Slavery in the U.S.A. The 13th Amendment to the U.S. Constitution Abolition of Slavery reads:

Unfortunately, there are still radicals out there that fight for such offensive and obviously ignorant causes.
