yes. he sings in the tenor range. baritones are much lower.
Actually, Josh Groban is a baritone with a tremendous range that reaches into tenor territory. He describes himself as a baritone, one of the reasons he was reluctant to stand in for tenor Andrea Bocelli at the Grammy rehearsal all those years ago. Groban didn't think he could sing the high notes required.

Nick isn't an alto or a soprano I'm afraid and the proper term that is used for men with unnaturally high pitched voices is called a counter tenor. I think he's just a normal tenor only his range is higher up on the scale; unlike his brothers he has a shorter range that starts higher up. I'm a tenor and i find it hard to sing the notes in some of his songs because the bridge between my head voice and falsetto is very weak. you'll find this to be very common in tenor's, the reason i say this is because nick seems to have a stronger bridge that leads up to his falsetto, which is the term used for a man's higher woman like tones lol. So i guess Nick is like all other tenor's the only difference is that he has a stronger head voice leading to falsetto.
btw there is only so many notes that a man can go before he reaches his falsetto. Because you asked this question in the first place i think you ought to know that this also happens to women too when they reach lower notes; they start to sound very manly. listen to Marilyn Horne's beautiful dreamer, that's a good example of super low notes for women.
