Yes so long as your backups are stealthed. If they are not properly stealthed then there is a very high risk of your console being detected and banned from live for life. Even if your console is stealthed this risk remains, however if you keep your console upto date and check the internet to make sure Microsoft are not running one of their random checks at the time which you wish to play online, then this risk is minimised.

They do have this new software out that makes your modded 360 100% undetectable and you can play whatever backup games you want. However with this being new software, it is pretty expensive.
