Please note, Runescape private servers are illegal and are shut down frequently. Jagex has the right to sue/put in jail the owners of the private servers. Users of private servers will not be affected though, although, may be subject to an IP block.

Can you sue somebody for hacking into your account?

Nope. All property in game, i.e. Money, accounts, items, is the sole property of Jagex. You didn't "steal" Jagexs money or account, so you can't make a claim. Plus, good luck finding a court who would that case haha :/
