Yes, you can rematch Kyogre but this is only possible in Pokémon HeartGold and only in the case of you knocking it out, you will be able to head to the Indigo Plateau to re-challenge the Elite 4 and then after you beat Lance, Kyogre will be regenerated as will all other one-off Pokémon that have been knocked out however once Kyogre has been captured then you can no longer rematch it.
