They were originally created for the film This is Spinal Tap (dir Rob Reiner, 1984). But they have released albums, done live shows, etc off the back of the film, so you could say they were a real band - ok, it's parody but very well observed and musically as good as plenty of 'real' rock bands.
Incidentally there is a story that Iron Maiden walked out of the London premiere of the film, because they thought it was taking the p**s out of them specifically.

I can't think of anywhere that would try it, because the potential for paralysis is just too high, as is the cost of doing a spinal tap, and any court would consider a spinal tap an unnecessary intrusion. Any drug they need to pull a spinal tap to test for is one they're not going to be real proactive about prosecuting.
