Are Madara and Tobi the same?
Yes, he is. As of Naruto chapter 599, it is confirmed that "Tobi" is in fact Obito Uchiha. After a cave-in supposedly "killed" his body, he was rescued by an elderly Madara Uchiha using the Gedo Mazo statue to preserve his life. Once Madara died, Obito adopted his name and carried on his plan, under the assumption that because Rin was gone, life had no purpose.

XD Pein may actually be a puppet of some sort to tobi, who claims to have the same power as Madara Uchiha, though madara is long dead by now, unless of course, madara is pull an Orochimaru, and has become a demon in his own right, jumping from body to body which is what happened in another anime inn which the character Dante swapped bodies from Full Metal Alchemist. Pein has taken the back seat to Tobi a few times, as so far as Pein has taken Tobi's orders seriously and has followed through on it, which might explain who it really was who decided that Pein was to follow up on the 9 tailed beast capture after Itachi Uchha and Kisame Hoshigaki failed to retrieve Naruto, thanks to Jaraiya, the toad sage. Also, due to Zetsu, the flytrap cannibal psycho, and his weird abilities, he has been given executive authority in the Akatsuki, and those orders most likely came from Tobi than from Pein, who may not be as stable or as focused as Tobi, who may be Obito, though only in part, according to another theory. There are theories that Tobi might be obito or even madara, and some of these explain his apparent identity crisis (as when he changes from happy-go-lucky to rash and arrogant), with one of them going like this, obito was found dead or half dead, but he was combined with some madara forbidden jutsu to reanimate him. Though this process required obito's mind to share the body with other's minds, or maybe Kakuzu, the one with 4 hearts, gave him a few of his or caught him a few of his own, though the hearts come with minds of their own that charge over Obito Uchiha's mind, which is comparitively weaker. There are also theories that Tobi is kakashi in disguise, as Kakashi Hatake also has one sharingan eye, who also has connections to Obito, since Kakashi was Obito's best friend and teammate, under the 4th hokage, Minato Namikaze. Kakashi fits the mold too as he is goofier than any of the Akatsuki members as Tobi is known to be, plus he has copied over 1000 jutsu with his sharingan eye transplant, so he can do various moves without revealing too much about him, having such as massive collection of jutsu that he can always keep his AL counterparts guessing.
