The operator of a vehicle is responsible for the vehicle he/she is driving.
His liability insurance on his car should transfer to the vehicle that he is driving.
Because - if you're driving a vehicle - your only concern should be the safety of the people in your vehicle and the other road users ! Using a mobile-phone while driving reduces a drivers concentration - and distracts the driver from operating the vehicle safely. ANYONE who kills someone through using a mobile while driving - should be charged with murder ! Ask yourself the question - what's more important - using your phone or a person's life !
Panic, pull over and then freak out! While pulling over you should note where you are. While running frantically in circles (out of traffic of course) call 911 on your cell. Tell them the problem and your location. If you have a fire extinguisher in the vehicle, you may want to use it at this most opportune time.
If you were cited then you need to appear, if you have coverage on another vehicle then you should bring that proof with you as you should be technically covered for driving another persons vehicle.
