If you are completely stopped, the person behind you will be at fault for BOTH cars since they didn't allow themselves enough time and space to stop safely.
That would be the other driver's fault, unless you were stopped somewhere that there was no reason to stop. If you have your emergency signals on, however, then it would be the other driver's fault regardless.
Yes but it would be beneficial to got to court and tell why the accident happened so the judge can rule fairly on the accident..
