I would say as soon as possible because whiplash is generally just a temporary bruising of the muscles in the neck. It causes pain in the neck from this bruising but it always goes away soon. If you have more serious injuries you need to find out about it and have it treated. This would include problems with the vertebrae which may or may not include need for surgery.

In the UK - you can claim for an acceleration of symptoms of a pre existing medical condition. For example in car accidents - whiplash is common which affects the cervical spine. If your spine has a pre existing degenerative condition you may be suffering no pain. But the car crash could lead to whiplash symptoms which last permanently into the future. A medical expert can scan your spine and see if it is degenerative and that expert will approximate how long the symptoms of pain have been brought forward. It depends. Were you at work when the accident occurred? And were you working to long because you were not allowed to take a break? If you were working to long and decided not to stop and take a break then it's you fault. If you were not at work on the clock when the accident happened than it's your fault.
