It doesn't matter whose name the car is under (or the insurance). If you are legally married, in the eyes of the law, neither of you have your own possessions...they are joint possessions. If you called the cops because your wife drove off in "your" car, they tell you it is a civil matter, not one for law enforcement.
I have been through this :(
Once you go to a lawyer and draw up papers regarding whose is what, and file a separation, then you can show those to the police and they can enforce it...but as long as you are legally married, you are SOL.
IF the TITLE is in your name only, you can take it back OR report it stolen.
Only you, if the car is in your name, can report it stolen. So they are jacking you up to get their payments
You might want to re-check your laws. If the vehicle is in just your name, most states will allow you to report it stolen, if it's taken without your permission, even by your spouse.
rport it stolen?? Who will take the report?? Barney Fife??? NO, cause its NOT stolen. The 'stolen" line is a sure sign of a LAZY repoman. Or an uneducated repoman who believes everything they hear. How can you "steal" your own car? The lender CANNOT report the vehicle stolen. You, as the registered owner, are the only one who can make that report to the police.
If you only carry liability insurance, that is all that the insurance company is liable for in this state.
only the registered owner of the vehicle can report it stolen. If the kid took off with the parent's car, it is still not stolen...it's considered "taken without permission" because it is known who has the car. this can also be reported to the pd.
If the car is in your name and your former partner will not return the vehicle call the police and report the vehicle stolen. I would not cancel the insurance because this can only cause you more problems if the person damages the car or hits someone else. If it is in your name you may be responsible for damages.
Unfortunately, there is nothing you can do with your insurance company. If you only have liability insurance, they do not pay anything to have your vehicle replaced.
if you don't have an up to date MOT then your insurance is null and void. if your car is stolen then you are only covered if you have fully comp insurance!
Report it to the police right away. That way they can start looking for it. If you don't report it, not only will it not get found, but you also can't claim on your insurance. Aside from that there isn't much you can do (besides getting a cape, utility belt, and looking for it yourself).
The only way that can be a bad thing is if the car is stolen. You would have had to report it stolen prior to the ticket or accident.
If you only had 3rd party insurance then you cant claim. Usually the minimum level of insurance is 3rd party, fire and theft....best bet is to ring your insurance company and double check what your plan is, also file a report with the gardaí, its possible they can recover the motorbike.
