No, a repo man can enter your driveway but if the car is in a locked garage they do not have the right to enter without your permission. This rule applies to your home as well.
Was the gated garage really locked at the time the car was repoed?, Could have one of the other resident been coming or going so the gate was open when the repo people entered the property? Can you prove they broke in? Is there a security camera that will prove they did or didn't break in?
If the vehicle is behind a LOCKED, gated area, or in a garage, then yes, they (whoever is reposessing), can go to jail for trespassing. If the car is out in the open i.e. on a curb, in the driveway that's not gated, in a private parking lot (not gated), in a private parking deck, then they can and will repo the car, boat, anything that they have a court order to take for nonpayment. They can get anything that is out in the open. If they can see it, they will take it.
Legally, no. What the community's terms are on this may vary.
Legally probably not, that assumes you do not own the propery or the property(like a private road) to get to your property so that would be trespass. But someone has to call the police to enforce the trespass violation. After the repo guy has the car there is not much you can do except to sue the lender or repo guy. Gated,YES.Gated and locked no.
Yes.
If it's open access, yes. They cannot crash a locked gate or enter a building without permission.
YES. The repo company can take the car from anywhere they want with the exception of a boot on the vehicle and/or the vehicle is in a locked property such as behind a locked fence surrounding the property or locked inside of a garage. If you do not let the person onto your property with a locked fence surrounding this is a voilation of the law and ofcourse YOU can have them arrested on the spot.
The car can only be repossessed from a locked garage if the car is spotted in the garage from a window or a crack, but the repo company cannot enter the garage if the car was not visibly spotted.
They can go anywhere that's not locked.
No. However in most states it is a felony for someone to conceal a vehicle to prohibit a lender from repossesing it.
WE ACTUALLY HAVE A REPO T.V. SHOW. IF YOUR GATE IS LOCKED THEY CAN'T ENTER. IF YOU GET IN THE CAR THE CAN'T TAKE THE CAR, THAT'S KIDNAPPING (BEING MOVED 3 FEET BEYOND YOU WILL). THEY CAN CALL THE POLICE. YES THE POLICE WILL BE ON THE SCENE WHILE THE REPO MAN DO HIS JOB.
