It's been my experience the answer is yes. We also were rear ended, the other party was completely and totally At Fault. This caused me to have to get a lawyer as the insurance company was not paying the medical bills that were accumulating which I would have ultimately been responsible for. The Dr's were not interested in treating as well because they weren't getting paid. Having a lawyer guarantee's that the Dr's will be paid, you will get the treatment you need and you will not be responsible for the expensive medical bills. It also simplifies the billing process. If you receive a bill at home put it in the mail it goes to the lawyer. You will not have to spend hours on the phone trying to figure out who is billing who or lose sleep over whether or not you would have to be responsible for the huge expenses.
The insurance company won't pay out until you have a medical release, but how are you going to get a medical release if they won't pay for the treatment. Makes no sense.
Over and above medical coverage on your auto insurance. There is no way you can get out of telling your auto insurance company about the accident, because the health insurance company will tell them about it first. This also depends on whether or not your State allows health insurance to cover such accidents.
Yes it should, but the auto insurance company may have to pay the medical insurance after the claim is paid.
They or their insurance company needs to pay for damage and medical bills in the accident. If they don't have insurance, they can still be sued for the accident by the victims insurance company.
No, you shouldn't have to sign any forms after a car accident.
== == If no other vehicles were involved in this accident, the insurance company of the motorcycle driver has to cover the medical bills of the passenger who was injured.
yes and they usually do.
If you have medical, yes because your medical under your car insurance covers your passengers, regardless of fault.
If you have both medical insurance and auto insurance, the primary company billed will depend on the situation. If your injuries and medical costs were caused by an auto accident and you carry Medical Payments coverage, you will bill your auto insurance provider. If you do not carry Med Pay insurance coverage, as it is optional in the state of California, the circumstances will depend on who is deemed at fault for the accident. If the other party is at fault, you will bill their insurance company and will advise your claims adjuster as well. If you are deemed at fault and do not carry Med Pay, the only insurance you can bill is your medical insurance provider. Be sure your medical insurance provider does not exclude injuries caused in an automobile accident before approving chiropractic care.
Car insurance wont cover health insurance. Car insurance will cover any medical bills related to an automobile accident you are involved in though. If you were in an automobile accident, contact your auto insurance company right away.
You do not have to reimburse your insurance company if the accident is the fault of the other driver and the claim is made on their insurance. If the accident is the fault of the other driver and their insurance does not cover everything and you make a claim on your insurance for reimbursement, your insurance will subrogate (collect back) from the other company.
The un-insured driver will have to turn to their health insurance company for coverage if he carried no auto insurance.
