If the birth year is wrong this needs to be brought to the insuring company's attention immediately as the rates and policy are based in part on the age and health condition of the insured. If incorrect information is listed on the policy then that could be grounds for denial of coverage.

If a claim is denied because the birth year was answered incorrectly, for any reason, you still have a valid claim. You should contact The Center for Life Insurance Disputes for free counseling.

Can I be sued for a bad faith insurance claim?

Usually in a bad faith insurance claim the insurance company is in the wrong. A bad faith claim is when an insurance company fails to pay out what was promised on the claim. More than likely you could sue the insurance company and have a chance at winning your case.

Insurance Claim Denial Information?

Get StartedIf your insurance company has denied your claim, you should have been sent an Explanation of Benefits (EOB). Read this document carefully to determine the reason for the denial. Your insurer may simply be requesting more information about your claim. If so, gather the necessary information and resubmit your claim. If the EOB is not simply asking for additional information, then you should contact the insurance company either by phone or in writing regarding the denial of your claim. The address and phone number of the insurance company should be listed on the EOB. Be sure to include your account number and any other important information that might help with the processing of your claim. If you phone the insurance company, be sure to write down the name of the person you spoke with. This information is important for future communications with the insurer. After you have learned the reason(s) for the insurance company's denial of your claim, you should resubmit your claim, attaching additional information to address each of the insurance company's concerns. If the insurance company continues to deny your claim AND you think that they are wrong, then you can contact your State Insurance Department.

What should you do if your insurance wouldn't pay your claim on your totaled vehicle because the driver was not insured on the policy at the time?

Most of the time an undisclosed operator does not result in the denial of a claim. If the driver of the car was an excluded operator then that is a different story. If you feel that the action of the insurance company is wrong then you should contact your state's insurance department to file an appeal or complaint.

If you claim with their insurance do you have to claim with yours?

Your policy will have wording like, 'you must promptyly report ALL claims/accidents' it's a good idea to let your company know in case something goes wrong with the claim, comparative negligence assessed against you etc.

Can an auto insurance company refuse to take your claim in ca?

If they feel your claim is not legitimate then yes they can. This is the same in any country or state. If you feel they are wrong to do so then it is up to you to approach the relevant arbitrator (the FOS in the United Kingdom but this will be different I suppose in the US). Your other option is to sue, as if your claim is legitimate then they are in breach of contract.

Somebody loss a utility tire and hit my car messing it up are you responsible for paying the 500?

My car was hit by a run away tire. The other guy's insurance will cover my claim, as opposed to going through my insurance. They have State Farm Ins, I spoke with their Adjuster and she said that if we claim through our insurance the $500 will be subrogated and that we would get that money back. End result, if I pay it and the other guy was responsible I get my deductible back. If I claim through my insurance it better be a fallen object comp claim, or else they treat it as a COLLISSION and I would then have to ask for accident forgiveness. I did nothing wrong, so it doesn't fly with me to have to ask for "forgiveness", which would stay in my record. We're claiming with the other guy's insurance.
