I would say you both have the responsibility to watch out for each other's lives and possessions.
The person opening the door should have been aware of being in a parking area and therefore should have anticipated wether a car was coming or not.
The person driving the car should have known that people in a parking area move around cars to either get to their car or move from it. A person opening a car door is a much occurring action.
I would say the person opening the door is most likely to be blamed since he/ she had to take more precautions.
the person pulling out
The car pulling from the parking space is at fault
I would have to say that technically it would be the driver pulling out of the parking space. TECHNICALLY speaking that is. The insurance companies would probably try to say it is an equal at fault accident maybe.
I beleive, whoever's car is moving (wheel-wise), is at fault.
It is your fault.
Unless thare are other than normal circumstances, the driver of the parked vehicle would be at fault as it is his duty to ensure that it is safe to join the carriageway...
If you are pulling out and hit the other car.....you are. Person in the lane has the right of way.
it is the person coming out of the parking space
My fault
Backing up--it is your fault.
Yours.
It can be called a 50/50 accident... ususally the adjuster can determine that.
