It is your fault.
it is the person coming out of the parking space
The person who drove their car into the parked car.
It would be the car who has driven past, then reversed into you.
If you back into somthing its your fault regardless of whether it was parked improperly or not. You were suposed to be looking
the one that is at fault is the driver that pulls out of their space that then caused both cars to crash . the one at fault should have waited until the other driver parks .
It would be your fault, so your insurance company will pay. Unless of course, you have no insurance or you flee then his/her "no-fault" insurance would pay for the damage.
Unless thare are other than normal circumstances, the driver of the parked vehicle would be at fault as it is his duty to ensure that it is safe to join the carriageway...
A car in reverse is almost always at fault if it gets in a collision, unless you can prove that the other vehichle was driving recklessly.
It is ALWAYS the fault of the vehicle reversing out - as he should have reversed into the space so he could drive out forward thereby being sble to see where he was going !

Put the car back in the space and take a picture to bring to court with you. I had a similar incident and won the case. I still had to pay for being parked illegally but at a significantly reduced amount.
