Something similar happened to me. My own insurance company was actually going to just pay the other person's insurance company since they had decided I was "At Fault". I wrote a letter that I was not in agreement with this and stated my reasons why I was not at fault. It went into arbitration by a third party and I was determined to be NOT at fault. I believe you have to contact your company, also check the wording of your policy for how to handle disputes.
