States should have the right to determine the recognition of same-sex marriages based on principles of federalism and individual state sovereignty. This allows for diverse perspectives and values to be reflected in state laws, and allows for local preferences to be taken into account.

Do you need a divorce if you now live in a state that does not recognize common law marriage?

If your state doesn't recognize common law marriage then you cannot create one. If you live in a state that recognizes common law marriage and then move, you may need a divorce in order to dissolve that relationship.Although states are supposed to recognize marriages that are legal in other states they do not do that consistently. Many states will not recognize legal same sex marriages. State laws on this issue may vary and it's murky as well since many entities in your new state, such as health insurance companies, won't recognize your marriage. You should consult with an attorney who specializes in marital law.If your state doesn't recognize common law marriage then you cannot create one. Should same-sex marriage be legalized in Kentucky?

This is a question that is best left up to the people of Kentucky. I personally feel that same-sex marriage should be legalized there. I feel more strongly, however, that my New York marriage should be recognized in Kentucky and that no state should be able to pick and choose what marriages they recognize. Kentucky recognizes all New York state marriages, except those that are between persons of the same sex. I feel that is discriminatory, but then again there is no law prohibiting sexual orientation discrimination in Kentucky.
