It would clearly be illegal. No one is allowed to tattoo without a license. And no one may tattoo a minor. There is an exception to cover an existing tattoo where a parent may take a 16 or 17 year old to a tattoo parlor.
In most states they can, but there is some states who don't allow that. I know Michigan doesn't care how old you are as long as you have parent's permission. that's why you'll see like 14 year olds with tattoos there, I go there every summer to visit family and old friends.
