You could use any magnification you wanted- but extremely high powered scopes would be useless- the field of view would be so small, you could not find your target. The largest I use on a varmint rifle is 24X- and I would not use that on a hunting rifle. Military sniper rifles generally use less powerful scopes than that.
The best scope to use for hunting is one that isn't cheap. The cheaper the scope is the lower the quality it is. In this instance, one gets what they paid for. The best Leupold Scopes are ones that are of the measurements 3.5-10x40mm.
The possession and use of night vision scopes is legal. Using them for hunting is not.

The brands of spotting scopes that are the best is Alpen, Burris, Bushnell, Leupold, Nikon, Simmons, Tasco, Vortex, Yukon and Zeiss. I believe any one of these makes would meet your needs.
