Yes. Even though some states make exemptions to CDL laws on private property (and even though it actually puts them in conflict with the federal law, hazmat is another matter. If you have a hazmat spill, the law will come down on you like a ton of bricks for not having a CDL and hazmat endorsement.
At home (on land) call your local Fire Department. They will send a fire crew and a Hazmat truck. If at sea, notify the US Coast Guard as soon as possible.

Oh, yes. These things are typically based on the monetary amount of damage caused, and a hazmat cleanup is universally going to be expensive enough to qualify as a major accident. Whether it's deemed preventable or not is an entirely separate matter, but it is most definitely a major accident.
