Yes, it is in the contract. It apparently costs them more money than your contract is worth if you roam most of the time (approx. 80% of the time)

AT&T an T-Mobile phone plan prices are very competitive. Your phone plan is protected by a contract so you do not need to immediately be concerned about price changes. That time can be used to research all plans to find out which one fits your needs.
There are several phone plants for students available at Sprint. One can choose a 2 year contract and Individual plan or Family plan. Also one can choose to use a prepaid plan with no contract.
you probably do not have the correct phone or plan
You can do this as long as the old phone works with the tMobile network (or is unlocked to work on both AT&T and tMobile). But you need to call tMobile to have them active the new SIM chip. Basically, they need to connect your daughter as a customer to the new SIM. You should be able to take your old phone into any tMobile store and they should do this for you. Cannot say if they will charge you a small activation fee but it should not require another 2 year contract. They may try to push a new phone on you for free or small price so they can lock you into a new 2 year plan.
Yes, Tmobile does offer prepaid plans with the sidekick. You would have to buy the phone outright than set it up on the prepaid plan.
TMobile Broadband is a data plan available through TMobile. Phones and devices with TMobile Broadband use 4G networking, creating the highest speed of mobile internet. TMobile Broadband plans include the amount of web collected data you select such as 2GB, 5GB, or 10GB, and you will also receive unlimited Wifi access found at TMobile HotSpots across America. The best part of TMobile Broadband is the high speed connection and how inexpensive it is compared to other broadband plans.
Tmobile plans are pre-paid phone contracts. You pay a set monthly fee and in return get a set amount of call time, texts, and various other things dependant on the plan you choose. A tmobile plan can benefit regular phone users. http://www.t-mobile.com/shop/plans/prepaid-plans.aspx
