It is up to you. A contract means you can get the phone for free, and get a new one when the contract renews. Non contract is when you have to buy the phone up front and put a PAYG sim in it

I dont know why but i think you can just buy an iphone off amazon.com or overstock.com and put in your own phone company sim card into it. (EX: like I could put my T-Mobile SIM card into the iPhone.) The only way to do this that I know of would be if you had his sim card and put it into your phone. However, then your phone would ring with his number. Another way to do this is with a call forwarding service.

Put the SIM card from the new phone into the old one. Copy the contacts from the old phone's memory to the SIM card. Put the SIM car back in the new phone - then - either copy the contacts to the new phone's memory - or leave them on the SIM card. Either way - the new phone will find them.
