No, because Jailbreaking is legal now thanks to this act or whatever happend, and it would be hard to even shut down an iPod because it runs on wifi and not through AT&T wifi like iphones. so they can't really do anything since it's legal to jailbreak and the fact that you're using wifi.
Yes there is a chance that your ipod may break but its really small, the iphones have much bigger chance of breaking due to jailbreak. I jailbroken my ipod few times and it wasn't as great as I thought it would be, but you can try. If you ipod after the jailbreak appears to be stuck and you cant do anything with it, don't worry just simply press the home button + the shut down button at the same time and hold them until your ipod turns off and an apple symbol appear. That will restart your ipod and you will have to load the apple software again and you ipod will be as good as new.
