Jamey Sheridan wore an eyepatch on Law and Order: Criminal Intent because his character, Captain James Deakins, was injured in the line of duty. It added a touch of mystery and badassery to his character, making him even more intriguing to viewers. Plus, let's be real, who doesn't look cool as hell rocking an eyepatch?
It was an illness for the actor that was extended to his character.
Capt. James Deakins first appeared in the precinct with his face partly contorted and one eye covered with a large black patch on the May 1,2005 episode of NBC's Law & Order: Criminal Intent. His ailment (Bell's Palsy) was explained in two throwaway lines. But for Jamey Sheridan, 53, the actor who plays Deakins, it was a struggle just to say his line. In March 2005, Sheridan was diagnosed with the rare facial nerve disorder that causes one side of the face to be paralyzed. His left eye was constantly open, hence the need for a protective patch. Just speaking his lines took all his energy. Undaunted, the Los Angeles-based actor commuted as usual to the show's New York City set, where Criminal Intent's writers incorporated his condition into the script.

The first time he wore an eye patch was part of a costume. He was a pirate. In season seven, however, he lost his eye in a fight with Caleb (played by Nathan Fillion) and had to wear an eye patch from then on.
Lavi already stated in the reverse novel's that the eyepatch was not due to an injury. Although he was hit by a stray bullet, the earlier statement contradicts the main theory. The section where people talk about what Bookman said, that was to do with his hair that lavi pulled out due to the pain. The more plausible and canon theory for Lavi's eyepatch is to do with his role as a Bookman and his memory.

There are many different ways that caused pirates to wear an eyepatch. It could have been stabbed out by a stick or a sowrd. Or maybe they never lost their eye, it could have been blind from their birth. Another reason that they may have worn an eyepatch is if they have a lazy eye. It is also possible that nothing was wrong with any of their eyes, maybe they just liked how it looked on them.
