it can be proven any and everyday. you are the parent. you can tell the school they do not have the right to question your child with out you presents or on speaker phone. you as the parent have all the rights over your child do not let the system fear you into thinking that you do not.

my children are not aloud to be called into the principle office, counselor, etc without my presence or consent.

however, i am nice and fair. i want my children to learn they are humans and no one is allowed to disrespect them even adults. and yes what we believe to be good adults teachers, bus drivers, Sunday school teachers etc still must speak to our children with respect and not as lower class citizens.

if you believe your child was question illegally it's time for you to get the story from the school official and then call the local news. the local news loves stories about childrens rights being taken away in schools.

Is it illegal to interrogate a minor in Kentucky without a legal gardian?

A juvenile can be questioned by the police without his or her parents present as long as it is not considered to be a "custodial interrogation".Once the minor is taken into custody by police, a parent or guardian will be notified in order for them to come to the station. The police can question the minor without their parents present, howeever the minor is within their rights to remain silent and request a solicitor.

Can a 16 year old be questioned alone by police if the child was abused by her mother?

I believe in this situation England has the same laws as the US in which police cannot question anyone under the age of 18 alone however, a 17 year old may give consent to be questioned without a guardian present, anyone younger cannot be questioned whatsoever without a guardian.

Can a sixteen year old be questioned by police without a parent present?

Depends. Sometimes juveniles can be questioned with an adult present. Other times an adult MUST be present but it depends on the situation though.Added: Please define "questioned by."It depends on what type of "questioning" is being referred to.If the juvenile is in custody and being investigated and/or charged with an offense, a responsible adult should be notified (i.e.: school administrator - parent - social worker) - HOWEVER - if the officer is simply "speaking with" the minor in a non-custodial setting, no, it is not necessary.

Your son is 15 years old and got in trouble for paint balling a car The police questioned him without you being present Is that legal in the state of Pennsylvania?

It is illegal for the police in any state to question an underaged suspect without that suspect's legal guardian or a child advocate present thus anything said by a 15 year old to the police about any crime if said without a legal guardian or a child advocate present is illegally obtained evidence and can not be used in a court of law.

Can your 16 year old be questioned at school in Michigan after requestig the presents of her parents?

Of course you can continue to be questioned, however, anything you say cannot be used against you in most circumstances. In theory a minor cannot be questioned by Police without the presence of a lawyer or legal parent/guardian. A school official though, does not need your parent present to question you, but you do have the right to request him/her to stop questioning you until a parent arrives.
