∙ 7y agoThere are several modern legal principles that can be found in the Code of Hammurabi and these include:
1) Consistency: This is the idea that the law will apply in all cases in the same way and is so well understood in law today that it is almost difficult to imagine cases where the law is inconsistent. However, prior to the Hammurabi's Code, what was legal or illegal depended on the whims of the king rather than a set of laws, so theft could be punished harshly on Monday, not punished at all on Tuesday, and punished lightly on Wednesday. There would be no reasonable expectation of what the punishment would be for a certain act. By setting out the law, there was a clear consistency that theft would be punished equally severely on all occasions.
2) Punishment Correlated with the Crime: This is the idea that the nature of the crime will determine the punishment, as opposed to, say the social status of the victim, the location of the crime, the native language spoken by the criminal, or some other aspect not related to the nature of the crime. This is central to most forms of modern law.
3) Centrality: This is the idea that laws emanate from a central leadership as opposed to being up to local clan leaders for dispute resolution. This promotes regional unity and state-wide homogeneity in legal treatment and behavior.
4) Codex/Statutory Law: This is the idea that laws should be listed in an easy-to-read format so that a judge or attorney can simply find a statute and apply it. This is in contrast to case-law style legal systems where judges and attorneys need to extract legal principles from previous court decisions and analogize the situation. Case-law style legal systems are more open to different legal interpretations and inconsistent doctrines than statutory legal systems. Even most countries with a case-law legal system (US, UK, Australia, India, etc.) also have a large section of their laws which are statutory.
5) Enumeration: This is the idea that you should be able to refer to a law by a numerical citation as opposed to having to cite the wording by memory. Additionally, the numerical citation can allow other parties to independently verify that the law cited is correctly stated.
