No. Eliot Ness never had sufficient evidence to put Al Capone away. Ness in fact never met Capone face to face, probably because Capone could've killed him on the spot. The scene With Frank Nitti is also fake, Nitti committed suicide. Ironically Eliot Ness died as an alcoholic despite fighting the prohibition for many years. The story is hyped as a way to portray an American hero in a time where Italians were on the front cover of every magazine.
