It was in the news a few years ago, that the CIA was involved in some experiments in the 1950's with a Montreal psychiatrist, whose name, I think, was Dr. Allen or Ewan (or similar name) Cameron. In about the year 2,000 a court decided that these experiments were brainwashing and awarded the few surviving patients, some compensation. I think some religious cultists such as Charles Manson, and Rev. Jim Jones of the Peoples Temple cult, were reported as brainwashing their followers. I don't know how common brainwashing is. I believe I've been brainwashed by a large gang in Canada, since about 1980, and continuing to a lesser extent today, a sort of maintenance dose, to scare me out of circulation with the general public. I believe I'm a sort of unofficial political prisoner! Since I believe corrupt police are involved, I'd say, yes, brainwashing is legal.
