Technically, he makes an appearance by being mentioned as an easter egg. There are a couple of theories as to why Scarecrow is not in the game though. One is that the whole game Arkham City is just one of Scarecrow's nightmares that Batman is being subjected to. The other is that he just wasn't in this game, but will make an appearance in Arkham World when that comes out.
