Why is Hugh Mitchell not returning as Colin Creevey in Harry Potter and the Deathly Hallows?

Hugh Mitchell is not dead. He character never appeared after Chamber of Secrets so we can presume that either the actor expressed to wish in returning to the role, became to old to play the part or the new directors just decided that didn't want him. Certainly David Yates seems to have replaced him with the second year Nigel who never once appears in the book.
If Colin does not die in this film then there will be many annoyed fans.
