Actually if you go to Wikipedia and search, yes he was a real person, but he was a US senator around that time (curiously). But no, the outlaw is fictitious.

There is a Ben Wade in the Book "The Life and Adventures of Bigfoot Wallace". He was part of the group of a mail delivery team between San Antonio and El Paso. Of course, you have to be careful with Bigfoot Wallace. He has been known to "stretch the blanket".
