Just after the "first war", a lot of former Death Eaters "repented". At that point, the Dark Mark could just be the mark of someone who had previously been a Death Eater but was no longer, and not concrete proof. And before that -- well, it would be difficult to get one's hands on a Death Eater for long enough to look at their arm and hold a trial. They had Voldemort to back them, and it is hard to know who to check. Do you check every wizard or witch's arm? That might be hard, as a Death Eater wouldn't exactly present themselves to be checked.
