This is not always the case depending on factors causing the accident but most of the time it is the fault of the person who hit the other one in the rear. The reason for this is that if you hit someone from behind, you are the one who could have stopped the accident from happening. You were usually following the other vehicle too closely and did not have time to stop. This is usually the case.
