Generally when you are hit in the rear by another vehicle and both cars a re moving on a road the party in the back is deemed at fault. This is not always the case depending on factors causing the accident but most of the time it is the fault of the person who hit the other one in the rear. The reason for this is that if you hit someone from behind, you are the one who could have stopped the accident from happening. You were usually following the other vehicle too closely and did not have time to stop. This is usually the case.
It depends on the situation. If you stoped short and got rear ended it is your fault. But if you stoped becasue the driver in front of you stoped then it is that persons fault. As long as the parked vehicle is parked properly and not illegally parked in any manner, then the vehicle that rear-ended the parked car is at fault. Now if the parked car is sitting illegally (such as double parked or parked in a no parking zone, etc.) then the parked car is at fault or even both the parked car AND the car that hits it are BOTH at fault.
