This answer was provided by myself many years ago. Since the 31 May 2021 how compensation for whiplash in a road accident is calculated has been changed. Whiplash with symptoms up to two years is greatly reduced and subject to a tariff scheme.

The amount of whiplash you can claim depends on how your whiplash was caused. If in a road accident after 31 May 2021 and the whiplash is up to 2 years in duration then you may be subject to the new government tariff limiting the amount of whiplash that can be recovered.

If your whiplash was in another type of an accident or you were considered a vulnerable road use in a road accident - the amount of whiplash compensation would be subject to the old rules of caselaw and judicial guidance.
