If the car is titled soley in your name, you might try contacting the police department. Often they will try to help you negotiate its return. If the car is titled in both of your names or the police will not help, you will need to file for divorce or legal separation and ask the court to hold a temporary orders hearing. At a temporary orders hearing you can get an order that he give you the car and the court can award you the car in a judgment of divorce or legal separation. Contact an attorny for specifics about the laws in your state and for help getting the divorce process started. If an attorney is out of the question, your courthouse may have divorce forms to help with the process.

If he is just being a pain in the rear, take his set of keys when he is sleeping or watching TV and hide them somewhere good ;)
