like the title says, i was side swiped on the right back door of my 2013 charger by a 2013 Chevrolet Equinox. It was at a 4 way stop sign and i stopped like a normal driver and everything. When i was about 90% across the intersection and other car failed to yield and hit me on the right side. I told her either she pays for the damages in cash or i call the police and we settle this through her insurance. So Insurance it was. now after the 1 month long of her insurance telling me to do all this paper work and going to places to get my car inspected they decide to close my claim and stating they are not gonna pay me anything. why? because the police never issued the other driver a ticket for failing to yield at a stop sign. now two and a half months later i got my insurance involved and fighting with their insurance and supposedly they are going to fix it. My car is not badly damaged the door works fine but its very dented. so i have 3 estimates which i do NOT want to pay out of my pocket because its not my fault. highest estimate is 1950$ and the lowest is 1000$. I need help on what to do. I was told to do a Small Courts Claim and sue the other driver. any suggestion, please?
You can claim whatever you want. You'll get what the insurance adjuster gets you to agree to. You'll get nothing if the driver was indigent.
