The backing vehicle appears to be at fault - they should have been looking behind them to see what was happening there and seen the car coming out of the driveway.The car coming out of the driveway would have had their attention in the other direction, looking for oncoming traffic.
That depends on how quickly you need to get past the vehicle you're passing. If I'm passing on a two lane highway with no traffic coming the other direction, in my opinion, a reasonable speed would be 10-20 MPH faster than the vehicle you're passing.
there might be a textbook answer to that but if you are going to guestimate it out as your passing you will probably have a head on collision.So the real rule is only pass when its safe and do not cross a double yellow line .
