They would have to file a claim with the insurance company for any damages or injury. However, they cannot ask for money to reimburse them for punitive damages--that would be a civil case.

What if you are injured as a passenger in a car with no insurance?

If the driver of the car you were in was at fault and had no insurance you are out of luck. your only recourse if to sue the person who you were driving with to recover damages. If your driver was not at fault but had no insurance the other parties insurance would have to cover your damages. The lesson is not to ride with people who do not carry auto insurance, ever.

If you hit a parked unregistered car can you sue their insurance?

Sure you can sue anyone for anything. The question is will you win. Let's get this straight. You hit a parked car, and you want to sue the owner of that car's insurance company. And your reason is that the car was not registered. Well if the car was not registered then how did they have insurance? What does the fact as to weather the car was registered or not have to do with the accident? You hit a parked car and that means you were at fault. But you go right ahead and sue. See where that gets you.

If a passenger in an auto accident owns a car but doesn't have PIP does the driver's PIP pay damages to the passenger?

You are in a single car accident as a passenger the car involved is underinsured can you collect on your underinsured even though you were not driving and the vehicle is not listed on your policy?

no. you can not collect on something that you are not paying for. However... you can sue the driver, if this is what you want to do, call you insurance company and let them handle it. If you do not have an insurance company, call an attorney.
